Terms of Service

1. Who these terms are with

These Terms of Service (“Terms”) are a binding agreement between you and Trousdale Digital Technologies LLC, a Wyoming limited liability company doing business as “Red Homestead” (the “Company,” “we,” “us”). By creating an account, staking a parcel, or purchasing, you agree to these Terms, our Privacy Policy, our Refund & Cancellation Policy, and the Legal & Disclaimer.

2. What the service is — and is not

Red Homestead prepares, publishes, and maintains a documented, dated, good-faith homestead claim file for a defined parcel on the Moon or Mars, together with a collectible certificate. We do not, and cannot, convey legal title, ownership, or any presently-enforceable property right. No sovereign, court, or registry currently has jurisdiction to grant such title, and the 1967 Outer Space Treaty bars national appropriation of celestial bodies. Your purchase is not an investment and not a security, is made with no expectation of profit, and recognition of your claim by any future authority is not guaranteed and may never occur.

3. Your account

You must provide accurate information, keep your password confidential, and be at least 18 years old. You are responsible for activity under your account. Notify us promptly of any unauthorized use. We may suspend or close accounts that violate these Terms or are used for abuse or fraud.

4. Claimant information and the claim file

To issue your claim file we collect self-attested claimant details (legal name, mailing address, and the acknowledgments described at checkout). You represent that this information is true and that you make your claim in good faith with no knowledge of a superior prior claim. We do not require government-ID images or biometric verification. Once your founding claim is paid, your claim file is generated on Company letterhead and made available in your dashboard.

5. Products, fees, and billing

Prices are in U.S. dollars. Payments are processed by Stripe; by paying you also agree to Stripe’s terms. Subscriptions renew automatically until canceled. We may change prices prospectively with notice.

6. Refunds and cancellation

Refunds and subscription cancellation are governed by our Refund & Cancellation Policy, which forms part of these Terms.

7. Disputes within the registry; not legal representation

Counter-claims are resolved inside the Red Homestead registry under a published, objective rule of priority by date of properly-filed claim. The Claim Defense Desk prepares a formal opposition response and a Declaration of Priority that you sign and notarize. We are not a law firm, do not practice law, and do not provide legal representation or advice. Nothing is filed in any court on your behalf.

8. Acceptable use

You agree not to misuse the service: no fraudulent or duplicate claims, no attempts to breach security or access other users’ data, no automated abuse, and no use that violates law. You may not resell or represent the claim as conveying legal title or as a financial investment.

9. Intellectual property

The site, software, maps, generated documents, and content are owned by the Company or its licensors. Your issued claim file is licensed to you for your personal use and records. NASA and other public map data are used under their respective terms; we claim no rights in them.

10. Disclaimers and limitation of liability

The service is provided “as is” and “as available,” without warranties of any kind to the maximum extent permitted by law, including any warranty that a claim will be recognized. To the maximum extent permitted by law, the Company’s total liability arising out of or relating to the service is limited to the amount you paid to us in the 12 months before the event giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages. Nothing limits liability that cannot be limited by law.

11. Indemnity

You agree to indemnify the Company against claims arising from your breach of these Terms or your misuse of the service.

12. Governing law and venue

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-laws rules. The exclusive venue for any dispute is the state or federal courts located in Miami-Dade County, Florida, and you consent to their jurisdiction.

13. Changes

We may update these Terms. Material changes will be posted here with a new effective date; continued use after changes means you accept them.

Important legal disclaimer

No conveyance of legal title. The 1967 Outer Space Treaty (Art. II) bars national appropriation of celestial bodies, and no sovereign, court, or land registry currently has jurisdiction to grant or enforce private title to land on the Moon, Mars, or any celestial body. Red Homestead does not and cannot convey legal ownership or any presently-enforceable property right.

What you purchase. A claim-documentation and registry service — the preparation, notarization support, public publication, opposition-period adjudication, and continuous-possession recordkeeping of a good-faith homestead claim — together with a collectible certificate. It is a record of your claim and intent, not a title.

Not an investment; not a security. Your payment is not an investment of money in a common enterprise and carries no expectation of profit from our efforts. We make no representation as to resale value, appreciation, or return. The claim is not offered as a security and is not registered with the SEC, any state securities regulator, or any other authority.

No guarantee of recognition; no sovereignty; not legal advice. We model the process on frameworks in which documented good-faith possession was sometimes later recognized, but we do not guarantee any authority will ever recognize your claim. No Red Homestead claim asserts national sovereignty. Nothing here is legal, tax, or financial advice.
